Terms and Conditions:

DEFINITIONS

Event ‘means The Sussex Snowdrop Trust’s event as advertised’

Event Management Company ‘means any third party used by The Sussex Snowdrop Trust to assist,

organise or manage the event’

Order Fee ‘means any additional charges made at the time of purchase relating to handling, delivery

or transaction fees’

Terms and Conditions ‘means this document’.

Ticket Price ‘ means the face value of the ticket/tickets purchased’

We/ Us / Our ‘means The Sussex Snowdrop Trust’

You / Your ‘means the customer / purchaser / ticket holder to the Event’

 

By proceeding with the purchase of a ticket for an event as advertised you are accepting these Terms and Conditions of The Sussex Snowdrop Trust.

PURCHASE

1.1              In order to purchase a ticket to our event, you must be aged 18 years or above and have a valid credit or debit card issued in your name. Please note: You may be asked for proof of identity upon admission to the event.

1.2              Any tickets purchased from Us are subject to: (a) these Terms and Conditions; (b) any special terms and conditions stated to be applicable to the Event itself; (c) the terms and conditions of the Event Management Company (if applicable);

1.3              Your contract for purchase starts on confirmation of your order and ends immediately on completion of the Event date specified on Your ticket.

1.4              All purchases are subject to credit or debit card verification (if applicable), other security checks, and collection of payment by us. Your order may be cancelled if it has not passed our verification process or if payment is not received in full.

1.5              Tickets purchased by You are for personal use only. Unless otherwise agreed by Us, You must not re-sell, seek to re-sell, transfer or seek to transfer any tickets purchased.

1.6              Once You have purchased Your ticket for the relevant time slot, the time slot cannot be changed, amended or transferred unless otherwise agreed by Us. Please carefully check that You have selected the correct time slot before confirming Your order.

1.7              Any children’s ticket purchased for the Event must be purchased alongside an adult ticket. A parent or guardian must supervise and accompany children at all times.

1.8              It is Your responsibility to check Your ticket. If an error has occurred whilst purchasing the ticket, it may not be possible to rectify that error after purchase.

1.9              We reserve the right to cancel any order(s) that We reasonably suspect to have been made fraudulently or otherwise in breach of these Terms and Conditions, without any notice to You, and any tickets obtained as part of such order(s) will be void.

1.10          To prevent fraud and to protect The Sussex Snowdrop Trust, We reserve the right to carry out checks and/or request that additional information be provided in order to verify purchases.

PRICE AND FEES

2.1       Ticket Prices are clearly stated at the point of sale online. Tickets cannot be exchanged or refunded after purchase, save as for circumstances set out under clause 7.

DELIVERY OF TICKETS

3.1             Tickets will be provided electronically to You at the point of purchase. Each ticket will be given a unique code which will be scanned/checked upon entry to the Event. You may either bring a paper copy of the ticket with You or an electronic copy on Your mobile phone.

3.2            On occasion a limited number of tickets may be available to purchase at the event on the day.  Please always check the event information for this.

TICKET CONDITIONS

4.1         Any ticket You purchase from Us remains the property of The Sussex Snowdrop Trust and may be withdrawn and admission refused at any time. If this occurs without any act or omission on Your part, You will be refunded for the Ticket Price which has been withdrawn or for which access was refused (excluding any Order Fees).

4.2         Tickets are non-transferrable, please therefore ensure that You arrive at the event on time for Your allocated time slot. Late arrivals are unlikely to be accepted, in which case the ticket will become void and no refund will be issued. Early arrivals are not guaranteed admittance until the allocated time slot.

4.3                   We are not responsible for any lost, stolen or damaged tickets. We recommend that You do not post pictures of Your tickets online, without having covered the unique code number on Your ticket, as this may allow third parties to counterfeit Your tickets or otherwise compromise the integrity of the tickets.

4.4                   The Sussex Snowdrop Trust reserves the right to refuse admission to the Event if You exhibit threatening, abusive or anti-social behaviour, You are intoxicated or are behaving in a manner that may compromise health and safety or licensing guidelines.

ADMISSION

5.1       Please note that the advertised start times of the Event are subject to change and tickets are sold subject to Our right to alter or vary the programme of events due to circumstances outside The Sussex Snowdrop Trust’s reasonable control without being obliged to refund monies or exchange tickets, unless such change is a material alteration as described in clause 7.3, in which case the provisions of that clause shall apply.

5.2       The Event Management Company and / or The Sussex Snowdrop Trust may conduct security searches of You and other patrons for safety and security purposes and/or may refuse admission to patrons breaching or suspected of breaching these Terms and Conditions or any other terms and conditions of the Event.

5.3       Breach of venue terms and conditions or any unacceptable behaviour likely to cause damage, nuisance or injury shall entitle The Sussex Snowdrop Trust to remove you from the event.

5.4       The Sussex Snowdrop Trust reserve the right to refuse admission to the Event, or to remove any person from the event in order to secure public safety.

5.5       Certain items such as laser pens, weapons, or any other item that could cause harm or injury are prohibited from the event.  Dogs (except guide dogs) are also prohibited.

5.7       In accordance with clause 1.7, children must be supervised at all times.

5.8     The Sussex Snowdrop Trust does not accept liability for any loss or damage suffered, to include personal injury or death, resulting from attendance at this event.

5.9     By attending the event, You and those in Your party, consent to being photographed / filmed and may be featured as members of the crowd in any resulting photos, footage or recordings used on The Sussex Snowdrop Trust’s website, publications and social media platforms.  If you  do not wish photographs or video to be taken please contact a member of staff.

CANCELLATION AND ALTERATION

6.1       If the Event is cancelled, rescheduled, or materially altered, we will publish such information on social media and via The Sussex Snowdrop Trust’s website. However, we cannot guarantee that you will be informed of such cancellation or alteration before the date of the event. It is your responsibility to ascertain whether an event has been cancelled or altered and the date and time of any rescheduled event.

6.2      If the Event is rescheduled, We will give You the option to transfer Your ticket to a subsequent date or to claim a refund.

6.3       If the Event is cancelled in its entirety, We will provide You with a refund. Please note that this refund will not include the Order Fee referred to in clause 2.2.

6.4       In the event of a cancellation or change, The Sussex Snowdrop Trust cannot be held liable for any additional costs You may have incurred (to include, but not limited to, travel, accommodation etc.) or any other associated losses.

6.5       We will not be liable for any breach of obligations to the extent that any such breach is caused by any act of God, natural flood, fire (save where such fire is due to the negligence or fault of The Sussex Snowdrop Trust), lightning strike, earthquake, pandemic outbreak of an infectious illness, war, military operations, act of terrorism or riot, but nonetheless The Sussex Snowdrop Trust will use reasonable endeavours to perform its obligations.

6.6       The Sussex Snowdrop Trust reserves the right to alter the advertised dates, scheduled times of the Event, where it is necessary to do so for reasons beyond Our reasonable control.

YOUR RIGHTS

7.1       Cancellation

If the Event is cancelled in full (and not rescheduled), You will be offered a refund of the Ticket Price (excluding the Order Fee), plus the relevant Service Charges.

7.2       Alteration / Rescheduling

If the Event is rescheduled or Your allocated time slot (if applicable) is rescheduled, unless otherwise indicated, You will be offered tickets of a value corresponding with Your original tickets for the rescheduled time slot (if applicable), subject to availability. If You are unable to attend the rescheduled event, You will be able to obtain a refund of the Ticket Price (excluding the Order Fee). Failure to inform Us within any deadline specified by Us that You are unable to attend the rescheduled event will be deemed to be a reconfirmation of Your order for tickets for the rescheduled event, and You will not be entitled to claim a refund.

7.3       Other material alteration

If the Event is "materially altered" (as defined below), other than a rescheduling, You will be offered the option either to reconfirm Your order for the altered event or to cancel Your order. If You cancel Your order, You will be able to obtain a refund of the Sale Price of Your tickets (excluding the Order Fee). Failure to inform us within the deadline specified by us that You wish to cancel Your order in these circumstances will be deemed to be a reconfirmation of Your order for tickets for the altered event, and You will not be entitled to claim a refund.

For the purposes of these Terms and Conditions, a "material alteration" is a change which, in Our reasonable opinion, makes the Event materially different to the Event that purchasers of tickets, taken generally, could reasonably expect. In particular, please note that the following are not deemed to be "material alterations": adverse weather conditions; changes to the line-up of any multi-performer event; delays to the schedule of events; delays to the start times; change of location; technical issues regarding third parties on site (e.g. photographers); equipment failure resulting in partial closures to the Event.

LIMITATION OF LIABILITY

8.1       We will not be liable for any loss, injury or damage to any person (including You) or property however caused:
(a) in any circumstances where there is no breach of contract or a legal duty of care owed by Us

(b) in circumstances where such loss or damage is not directly as a result of any such breach (save for death or personal injury resulting from our negligence); or
(c) to the extent that any increase in any loss or damage results from Your negligence or breach by You of any of the terms of these Terms and Conditions

8.2       To the maximum extent permitted by law, We shall not be liable for any indirect, consequential losses or business losses, or any exemplary, special or punitive damages arising from Your purchase. In accordance with this, please note that:
(a) personal arrangements including travel, accommodation, hospitality and other costs and expenses incurred by You relating to the Event which have been arranged by You are at Your own risk.  We shall not be responsible or liable to You for any wasted expenditure, including where an event has been cancelled, rescheduled or otherwise materially altered; and
(b) We shall not be responsible or liable to You for any loss of enjoyment or amenity, including where an event has been cancelled, rescheduled or materially altered.

8.3       Unless otherwise stated in this clause 8, Our liability to You in connection with the event (including, but not limited to, for any cancellation, rescheduling or material alteration to the programme of the event) and the ticket You have purchased shall be limited to the price paid by You for the Ticket, excluding any Order Fee.

8.4       Nothing in these Terms and Conditions seeks to exclude or limit Our liability for death or personal injury caused by Our negligence, fraud or other type of liability which cannot by law be excluded or limited.

COMMUNICATIONS

9.1       If We need to contact You, We will use the contact details provided at the time of purchase. It is Your responsibility to inform Us of any changes to Your contact details, both before and after receipt of Tickets. In particular, please ensure that You provide Us with a valid email address as this is Our preferred method of contacting You. You should also be aware that Your email mailbox settings may treat Our emails as junk, so remember to check Your junk and/or spam folders.
